Terms of Service

Welcome to Stakes Golf. By accessing or using the Stakes Golf mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Stakes Golf. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Description of Service
Stakes Golf is a mobile application that helps golf groups track money games, calculate stakes and settlements, maintain season standings, and facilitate group competition. The app provides:
- Score tracking and leaderboard management
- Stakes game configuration and live scoring for various golf betting formats
- Automatic settlement calculation
- Payment link generation to third-party payment services
- Group management, standings, and head-to-head statistics
4. Important Disclaimer: Not a Payment Processor
Stakes Golf does not process, hold, transfer, or facilitate any financial transactions. The app calculates settlement amounts based on game rules and scores entered by users, and generates convenience links to third-party payment platforms (such as Venmo and Cash App). All actual money transfers occur entirely outside of Stakes Golf, on those third-party platforms, and are subject to their respective terms of service.
Stakes Golf is not a gambling platform. The app is a scorecard and calculator tool. Users are solely responsible for any money exchanged between themselves and for complying with all applicable local, state, and federal laws regarding recreational wagering and personal transactions.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Enter false or misleading scores, standings, or other data
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Service or its related systems
- Use the Service to facilitate illegal gambling activities
- Interfere with or disrupt the Service or servers
- Scrape, mine, or extract data from the Service without permission
- Create multiple accounts to circumvent restrictions
6. User Content
You retain ownership of any content you submit to the Service (group names, messages, profile information). By submitting content, you grant Stakes Golf a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as necessary to provide the Service. You are responsible for ensuring your content does not violate any third-party rights.
7. Intellectual Property
The Stakes Golf name, logo, design system, and all related intellectual property are owned by Stakes Golf. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
8. Accuracy of Calculations
While we strive for accuracy in all stake calculations and settlement computations, Stakes Golf is provided as a convenience tool. We do not guarantee the accuracy of any calculation. Users should verify settlement amounts before making payments. Stakes Golf is not liable for any financial disputes or losses arising from the use of our calculations.
9. Third-Party Services
The Service integrates with or links to third-party services including Venmo, Cash App, and golf course data providers. These services are governed by their own terms and privacy policies. Stakes Golf is not responsible for the availability, accuracy, or practices of any third-party service.
10. Subscription and Purchases
Stakes Golf may offer premium features through in-app purchases or subscriptions. Payment terms will be clearly presented before any purchase. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage subscriptions in your device's app store settings.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we reasonably believe is harmful to other users or the Service. You may delete your account at any time by contacting us.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAKES GOLF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Stakes Golf and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
17. Changes to These Terms
We may revise these Terms at any time. Material changes will be communicated through the app or by email. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
